Carga indebida

Una carga indebida es un requisito del Título II o Título III de la Ley de Estadounidenses con Discapacidades (ADA) que causaría una dificultad o gasto significativo si se llevara a cabo. Esto significa que un gobierno estatal o local o sus agencias, o una empresa u organización sin fines de lucro cubierta por la ADA, no tiene que proporcionar una ayuda auxiliar o un servicio, o una modificación, si proporcionarla causaría una dificultad administrativa o financiera significativa. La carga indebida es similar a las dificultades indebidas en virtud del Título I (empleo).

Al decidir si algo es una carga indebida, debe tener en cuenta varios factores. Estos factores incluyen el costo total de toda la organización y cualquier organización matriz, así como el funcionamiento y la naturaleza de la organización. Si una ayuda o servicio auxiliar constituye una carga indebida, la agencia u organización debe buscar una alternativa efectiva. Por ejemplo, si un museo pequeño y privado no puede proporcionar un intérprete de lenguaje de señas para una visita al museo con breve aviso, una copia escrita del guion del guía turístico podría ser una alternativa.
